- The Guest listed on the Rental Agreement and signing the same agrees to take full responsibility for
the actions, inactions and property of him- or herself, as well as all persons using the John 15
Vineyard facilities. Guest warrants that he or she has full authority to execute the Agreement on
behalf of any entity/group using the facilities. Guest further agrees to pay all rental amounts on the
Rental Agreement provided by John 15 Vineyard. Copies of this document and the Rental
Agreement will be given to the Guest at the time of signing.
- For the purposes of this Agreement, the “Premises” shall be defined as any and all real property,
buildings and natural features located at 343 180th Street, Scranton, Iowa 51462. For the purposes
of this Agreement, all persons using the Site shall be referred to as “Subguests.” For the purposes
of this Agreement, Dean and Nancy Rogers shall be referred to as “Rogers.”
- If any damage to or on the Premises results from any act of negligence of Guest or Subguests
during the use of the Premises, Guest shall pay to John 15 Vineyard the total cost of the repairs and
damages. Payment for such repairs and damage shall be paid in full prior to guest vacating the
Premises, unless otherwise agreed to in writing by the Guest and Rogers.
- John 15 Vineyard and its managers, agents and personnel, as well as Rogers, separately and
collectively, shall not be liable, and Guest waives all claims on behalf of itself and Subguests, for
any and all injuries or damages to person or property sustained by Guest or Subguests, resulting
from: A. Any part of the Premises, including any site, building or equipment; B. Any accident in or
about the Premises; or C. Any injury or damage resulting directly or indirectly from any act of
negligence of another guest or occupant of the Premises or of any other person. Furthermore,
John 15 Vineyard, its managers, agents and personnel, as well as Rogers, shall not be responsible
for the personal property of the Guest and Subguests, nor liable for damage or theft of such
property. All personal property belonging to or possessed by Guest or to any Subguest that is on
the Premises shall be there at the risk of Guest or Subguest only.
- Guest further agrees that John 15 Vineyard, its managers, agents and personnel, as well as
Rogers, shall not be liable, and Guest and Subguests waive all claims, for any and all injuries or
damages to person or property sustained while a passenger of or on any form of conveyance
provided for use by Guest and Subguests, whether owned exclusively by John 15 Vineyard, or
contracted by John 15 Vineyard, for the convenience of Guest or Subguests, including, but not
limited to wagons, cars, trucks, bicycles, vans motorized carts or all-terrain vehicles, taxis or buses.
- Guest on behalf of him- or herself, as well as all Subguests, shall hold John 15 Vineyard, its
managers, agents and personnel, as well as Rogers, harmless from and against any and all liability
for damages, costs, losses, and expenses resulting from, arising out of, or in any way connected
with the occupation or use of Premises by the Guest or guests of the Guest, or the failure on the
part of the Guest to perform fully the Guest’s promises contained in these General Policies.
- Guest and Subguests grant to John 15 Vineyard, and to Rogers, the right to their images and
names in all forms and media for any commercial purpose. Guest, on behalf of him- or herself, as
well as of any Subguest, hereby waives the right to inspect or approve versions of any image used
for publication or the written copy, that may be used in connection with the images. Guest hereby
releases John 15 Vineyard, and Rogers from any claims that may arise regarding the use of
Guest’s image, and agrees to hold harmless John 15 Vineyard and Rogers from any action brought
by any Subguest for any such claims.
- In the event that the Guest’s use of the Premises and/or Site is made open to the public, Guest
agrees to obtain liability insurance covering the planned event. Such insurance policy shall include
John 15 Vineyard, and Rogers as additional insureds, and Guest shall provide a certificate of
insurance to John 15 Vineyard.
- This is a private experience located on the grounds of our home. We reserve the right to refuse
admittance, rental or service at our discretion.
